Participants
The Competition is open to anyone of legal age who wishes to enter, both amateurs and professionals who are the authors of the pictures presented or who hold the rights to them, with the exception of employees of the Fundació Turisme Palma 365 (hereinafter, “FTP 365”) and the members of the jury.
Object of the competition
Palma is becoming an attractive urban tourist destination not only for the summer months but for all the days of the years thanks to an imaginative and differentiated offering of high quality. Consequently, and to display the new image of Palma, we are setting up the 2nd Official Palma 365 Photography Competition, an event that is open to all the public, transparent, dynamic and participatory.
The photographs entered have to show a modern, dynamic, happy, lively and cosmopolitan image of the city and explain why the Balearic capital is “The world’s best city to live in.” For this reason, it is important for the photographs to be up to date and to convey certain sensations or experiences that will inspire future visitors to come here.
With this second edition, the aim is to turn the competition around and professionalise it with the goal of capturing greater photographic quality.
Themes
VERY IMPORTANT! In addition to photographs with a traditional vision, we will value the presentation of images with a different perspective from the habitual views, that are not mere still lifes but show things happening.
The Palma 365 Photography Competition organised by the Fundació Turisme Palma 365 wants to publicise Palma through the eyes of photographers. For this reason, the images presented must have been taken in the city.
Four (4) different categories are proposed, articulated as follows:
A) Cosmopolitan Palma: images that portray the most urban Palma.
B) Familiar and accessible Palma: other ways of living Palma; photographs that show that Palma is a city for everyone.
C) Palma Beach: the new image of this tourist zone.
D) Is this Palma? Showing the day-to-day life of the city, the things that happen in its places that may be little known but not for that any less surprising, in addition to showing how residents and tourists interact in these places.
One single entrant may not submit more than 6 photographs per category. The photographs must duly identify the category in which they are entered. One single photograph may not participate in more than one category.
General requirements
No images will be accepted which show identifiable underage children unless the entrant has the written authorisation and consent of the child if they are 14 or over or of their parents or legal representatives if they are under 14.
The photographs presented may have been taken before the opening date of participation in this competition.
The photographs may not have won prizes in other competitions, nor may they be very similar to other prize-winning photographs by the same author.
Any photograph which fails to comply with the requirements will be disqualified.
The photographs may not include any signature or watermark.
No photographs will be admitted which violate the industrial or intellectual property rights of third parties.
No photographs will be admitted which display sexual content; criminal, humiliating or violent actions; political or religious proclamations; racist attitudes or any other type of discrimination; contents which are offensive or in bad taste; and so on.
No photographs will be admitted which infringe the protection of infants and people’s right to honour, dignity and privacy or any other current legislation.
Black-and-white photographs are admitted.
Format of the photographs
Only digital files are admitted. They must be in JPEG format, with a resolution of 1920 pixels on the long side in the highest quality. The title and the place where the photograph was taken must be indicated.
Processing. In regard to the processing of the photograph, free editing is admitted provided the adjustments are made for creative purposes and comply with the principles of authenticity of the competition, in such a manner that they do not constitute an attempt to deceive the public or present reality in an undue manner.
In the processing of the photographs, framed images will not be admitted.
If the submitted photograph is selected, it must exceed 8 MP in order to be printed.
The submitted images may be modified at any moment until participation in the competition is closed. The entries will be closed automatically on the date indicated in the “Registration Data” section of the present regulations, which will activate at that moment the “Close of participation” for all the photographs which each participant has included in their menu of “Provisional images submitted.”
Acceptance of the regulations
Participation in this competition entails the acceptance of each one of the regulations and the final decision of the jury. The Organisation is entitled to rule on any eventuality not provided for herein.
Sending the pictures
The photographs must be sent via the website www.palma365.es by means of the admission form which appears there and in accordance with the sending instructions. The FTP 365 accepts no responsibility for any interruption, temporary lack of availability or continuity of operation of the network or the software, or for any problems in transmission, failures of access or communication, loss of information, etc.
The photographs presented may be used in the various dissemination platforms of the FTP 365 for the promotion of the participatory phase of the competition.

The registration is free of charge.
The starting date of the competition will be October 15th, 2018. The deadline date for receiving photographs will be November 18th (inclusive). Any photographs sent outside of these dates will not be taken into account.

Prizes
VERY IMPORTANT! In addition to photographs with a traditional vision, we will value the presentation of images with a different perspective from the habitual views, that are not mere still lifes but show things happening.
Each category will have 1 first prize endowed with €1,000 and 3 runner-up prizes endowed with €300. A category prize may be declared not awarded if the quality of the photographs is not at the same level as the rest of the categories.
In addition, a special prize named “Palma 365” is established, the winner of which will be selected from among all the winners of the various categories of the competition and which consists in photographic material for a maximum value of two thousand euros (€2,000).
All the prizes are subject to taxation pursuant to the current regulations.
Visibility for the winners:
Exhibition. From January 17th to February 20th, an exhibition of the winning photographs will be held in the courtyard of the Casal Solleric in Palma (dates subject to possible fluctuations).
Catalogue. With the aim of rewarding the participation of the winners and the runners-up, the Fundació Turisme Palma 365 will create a catalogue of the exhibition, in digital version and a limited print edition. The future possibility will be evaluated of making this catalogue an official gift of the city and even incorporating it into Palma’s merchandising line, since the result will be of extremely high quality.
Jury
The jury will be formed by representatives of the FTP 365 and/or of the Palma City Council and by the ambassadors of the competition (prominent members of the world of photography). The composition of the jury will be announced at the verdict of the competition, which will be published on the website www.visitpalma.com and/or the City Council’s website (www.palmademallorca.es) along with the social media of the FTP 365.
The jury’s decision will be announced no later than the month of December 2018. The winners will be notified by means of the data supplied on the registration form. The winners must expressly confirm the acceptance of the prize within five business days following notification.
If the notification cannot be carried out, a winner fails to accept the prize within the stipulated period or in the established manner, or waives or fails to comply with the established mechanisms and requirements set out in these regulations, the FTP 365 reserves the right to declare unawarded the prize of that category of the competition or to select another photograph as the winning entry. The jury may also propose that the competition or any of the categories be declared void if the images submitted by the participants do not reach the expected quality level.
Rights on the photographs
Each entrant declares and guarantees that he/she is the holder of all of the rights, of both intellectual and industrial property, of the photographs submitted to the Palma 365 competition. The FTP 365 accepts no liability for non-compliance with any regulation or for any infringements of third-party rights committed by the participants within the framework of the competition.
In the event that the photographs include images of persons who are identified or identifiable, it is an indispensable requirement to request their written consent and authorisation. The FTP 365 may request this written consent from the participant at any time. Not having this consent and authorisation will be grounds for exclusion of the photograph in question.
Once the selection process of the finalist or special-mention photographs has been completed, the original files will be requested. The winners and runners-up assign to the FTP 365 the exploitation rights of the images submitted to the competition, which include the rights of their use, distribution, exhibition, public communication, dissemination and reproduction and the right of transformation to adapt them to the publicity or promotional requirements of the FTP 365 and to the object of this competition. This assignment is made, in non-exclusive manner, with no territorial or time limits from the moment of participation in the competition.
The non-prize-winning participants in the competition assign to the FTP 365 the exploitation rights of the images submitted to the photography competition, which include the rights of their use, distribution, exhibition, public communication, dissemination and reproduction and the right of transformation to adapt them to the publicity or promotional requirements of the FTP 365 and to the object of this competition. This assignment is made, in non-exclusive manner, with no territorial limit and with a time limit of 3 years from the moment of participation in the competition. At the end of 3 years from the end date of the competition (that is to say, from November 18th, 2021), the FTP 365 will eliminate all the images which have not won a prize or special mention. Only in certain cases, when the FTP 365 wishes to continue to use these images for its activities, a permanent assignment of the corresponding photographs will be negotiated with the non-prize-winning participants.

(6) Right not to be the object of individualised decisions. You are entitled not to be the object of a decision based solely on automated processing, which includes the creation of any profiles which may produce juridical effects or affect you, unless such processing is necessary for the performance of a contract, is permitted by law or you have explicitly consented to it.
(7) Right of portability of the data. You are entitled to receive your personal data in a structured, common mechanical-reading format and to transmit it to another party responsible for processing.
(8) You are also entitled to file a claim before the Spanish Data Protection Agency if you consider that a breach of the data protection legislation has been committed with regard to the processing of your personal data.
