The Competition can be entered by anyone of legal age, with the exception of employees of the Fundació Turisme Palma de Mallorca 365 (hereinafter, “FTPM365”) and members of the Jury.
OBJECT OF THE COMPETITION
Palma is becoming an attractive urban tourism destination every day of the year and not only during the summer months, thanks to its high-quality, imaginative and differentiated offering.
In order to reflect and publicise this new image of Palma, always from the point of view of the end customer, the city is launching the Palma 365 photo competition, which seeks the involvement of both Palma’s tourists and its citizens. The event is open to everyone and is transparent, dynamic and participatory.
The photographs submitted must be capable of transmitting the concept “Live Palma.” The idea is to project a modern, dynamic, happy, lively and cosmopolitan image of the city which explains why the Balearic capital is “the best city in the world to live in.” For this purpose, it is important for the participating photos to be fresh and up to date and to convey sensations or experiences capable of motivating future visitors.
The photos submitted will be incorporated into the image bank of the FTPM 365. The aim is to provide a response to the queries and requests that Palma’s tourism promotion agency habitually receives from third parties.
The photos submitted have to be taken in Palma. Five (5) different categories are established, articulated as follows:
A. Culture, understood as images depicting festivities and traditions, emblematic buildings, museums, art galleries, courtyards, churches, etc.
E. “Live Palma”: photos that tell a story, an anecdote or an experience, all the fun and excitement of the city.
An entrant may not participate with the same photo in more than one category.
In any case, in addition to photos with a more traditional vision, value will be given to photos taken from an original perspective, which are not still-lifes and in which things happen.
MECHANICS OF THE COMPETITION
The following photographs will not be admitted:
If they are in black and white.
If they bear watermarks, logos or identifications of the author.
If they violate industrial or intellectual property rights of third persons.
If they reproduce a recognisable image of third persons without their consent.
If they show sexual content; criminal, denigrating or violent actions; political or religious proclamations; racist or discriminatory expressions; offensive or unpleasant contents, etc.
If they infringe the protection of infancy and the right to personal honour, dignity and privacy, and any legislation currently in force.
The works submitted may not have been published previously in any magazines, newspapers or books, printed or online, or have been submitted to any other photographic competition.
Participation in this competition implies the total acceptance of these Rules. Any breach hereof will entail the automatic disqualification of the participant, as will any case of falsification of data and/or breach of intellectual property rights of third persons.
SENDING THE WORKS
The photographs must be sent to the website www.palma365.es, completing the admission form which appears there and following the sending instructions.
Each entrant may participate with a maximum of 3 photographs per category per week. They must be submitted in JPG format of a minimum of 3 Mb, stating the title and the place where the photograph was taken.
The FTMP365 accepts no liability for any interruption, temporary lack of availability or continuity of operation of the network or software, or any problems in transmission, failures of access or communication, loss of information, etc.
The photographs submitted may be used in the various dissemination platforms of the FTPM 365 to promote the participation phase of the competition.
The Palma365 Photo Competition will commence on February 15, 2016 at 9:00 GMT +1 and will terminate on April 15th, 2016 at 14:00 GMT + 1 (2 months). Any entry received outside of this period will not be considered valid and will therefore be rejected. However, the FTPM 365 reserves the right to extend or suspend the competition in duly justified circumstances.
Prizes for stimulating participation in the competition
Coinciding with the duration of the Palma 365 Photo Competition, that is, during the weeks in which it is open for participation, the FTMP365 wants to encourage and reward this participation. To this purpose, it plans to award periodical prizes named “Palma 365 Photo of the Fortnight,” which will be presented every two weeks, up to a maximum of 4 awards/prizes.
All communications related with these fortnightly prizes will be made via the website of the competition and/or the social media of the FTMP365.
The winning work will be selected from among the photos which have participated in this period (between prize and prize) by representatives of the FTMP365 and/or the Palma City Council. These periodical prizes will consist in weekend stays in a hotel in Mallorca but will not include the travel expenses or any additional expense associated with the enjoyment of the prize. The winner may choose the dates of the stay by common agreement with the organisation of the competition. The Fundació reserves the right to substitute the prize with another of a similar value.
At the end of the period for submission of photographs laid down in these Rules, and therefore of participation in the competition, and following the decision of the Jury, the final prizes will be awarded. The prize for the winner of each of the categories comprising this competition consists in a weekend trip for two to a European capital. The prize does not include the winners’ transfer expenses to and from the airport of departure from their place of residence, nor any additional living expenses or any others associated with the enjoyment of the prize.
In addition to this trip, a special prize is established named “Palma365,” the winner of which will be selected from among the winners of the various categories of the competition. It will consist in a cash amount of five hundred euros (€500) and photographic material for a maximum value also of five hundred euros (€500).
The finalists, the winners and their creations may be publicised in a local communications medium. Their works may also be the subject in the year 2016 of an exhibition in a municipal establishment.
The trips and the photographic material may not be exchanged for their value in cash or be assigned to third persons.
All the prizes are subject to taxation under the current regulations.
JURY, SELECTION OF WORKS AND VERDICT
The selection of the finalists and winners of each of the categories comprising this competition will be the responsibility of a Jury formed by representatives of the FTPM 365 and/or the Palma City Council, professional photographers or other persons considered of interest. The composition of the Jury will be announced along with the verdict of the competition, which will be publicised on the website www.visitpalma.com and/or on the website of the Palma City Council (www.palmademallorca.es) and the social media of the FTPM 365.
The Jury reserves the right to accept or reject the works according to whether or not they adhere to the established themes and certain minimum criteria of technical quality. Moreover, the Jury is assigned the competence, in addition to the evaluation of the photographs submitted by the entrants, of interpreting these Rules and settling any issues which may arise in relation with this competition.
The Jury’s decisions are final.
The winning works will be selected within a maximum of two months from the end of the submission period, in two phases:
The Jury will select from among all the photographs submitted to the competition a minimum of ten (10) finalists per category.
Subsequently, the Jury will meet to choose from among all the finalists an absolute winner of each category and the special prize named “Palma365.”
In the first phase, the Jury, in addition to announcing the finalist photographs on the website of the competition (www.palma365.es), reserves the possibility of displaying them via the websites and social media of the FTPM 365 and/or the Palma City Council or any other communication channels which they may consider appropriate. In any event, the winning photographs will be publicised via these media and any other communication channels which may be considered appropriate.
The condition of winners will be communicated to the participants by means of the data provided on the entry form, and the winners must expressly confirm that they accept the prize within the three business days following the notification.
If the notification cannot be carried out, or if a winner does not accept the prize in the stated period or manner, relinquishes it or has failed to comply with the mechanism or the requirements laid down in these Rules, the FTPM 365 reserves the right to declare this category of the competition void or to select another photograph as the winner. The Jury may also propose that the competition or one or more of its categories be declared void if the photographs submitted by the participants do not reach the expected quality level.
RIGHTS ON THE PHOTOGRAPHS
Each entrant warrants that they are the holder of all the rights, of both intellectual and industrial property, of the photographs submitted to the Palma365 competition. The FTPM 365 is not responsible for any breaches of any rule or any infringement of third-party rights committed by the participants within the framework of the competition.
If the photographs show images of recognisable persons, the entrant must be authorised by those persons to use their image. In this respect, if the FTPM 365 considers it necessary, it may request from the entrant this authorisation in writing and the certification of the identity of the said persons.
The participants assign to the FTPM 365 the exploitation rights of the works submitted to the competition, including the rights of use, dissemination, distribution, exhibition, public communication, divulgation and reproduction thereof, in addition to the right of transformation to adapt them to the publicity or promotional needs of the FTPM 365 and the object of this competition. This assignment is made, in non-exclusive manner, with no territorial or time limitation from the moment of entry into the competition.
In addition, the FTPM 365 reserves the right to use the participants’ names associated with their corresponding photographs.
PERSONAL DATA PROTECTION
In accordance with the Personal Data Protection Act nº 15/1999 of December 13, and by completing the entry form, the participants give their consent to the processing of the personal data they have provided, which will be incorporated into the file of entrants of which the holder is the FTPM 365.
The entrants may exercise the rights of access, rectification, cancellation and objection laid down in this Act by means of a registered letter, enclosing a photocopy of their National Identity Document or of an equivalent document to certify their identity, sent to the following address:
